Profile

Four separate applicants. An I-485 filed in December 2023 and asked for verification of employment from three past employers. An I-485 asked for Supplement J. An I-751 and an I-765 each received the standard RFE cover notice.

What was claimed

What happened

I-485 verification of employment (April 2024 notice): current verification of employment from three employers, on company letterhead with start and end dates, job title, salary and reason for leaving, submitted in a sealed envelope from the employer. Response due 89 days after the notice.

I-485 Supplement J (notice due August 2026): submit a properly completed and signed Supplement J showing that the offer in the I-140 continues to exist or that the applicant intends to port to a same or similar occupation.

I-751 and I-765 notices (due November 2025 and September 2026): the standard cover notice. The response must be received by the date shown. The deadline cannot be extended under 8 CFR 103.2(b)(8)(iv). All requested evidence must be submitted at the same time. The original notice must be returned with the response. Foreign-language documents need a certified translation and a copy of the original.

Processing resumes after USCIS receives the response, and the notice gives a 60-day contact window for the I-751 and I-765.

Lessons for evaluating your own case

Every notice is a list of what to fix. Use these as a checklist for your own evidence.

  • The date is received by, not mailed by. Count the mail time and use the tracked route.
  • Send everything at once. A partial response is treated as a request for a decision on the record.
  • Return the original notice. It carries the unique number that connects the response to the case.
  • For employment verification, ask each past employer early. Letterhead, specific fields and sealed envelopes take time to arrange.
  • Keep a Supplement J plan if you may change jobs. Decide how it fits with AC21 portability rules with your attorney.
